We explain the ways how we are processing personal information of visitors and users of our website and services shared with NanoTemper to produce satisfying products and services. We want you to understand clearly which information we collect and process with your consent. With the use of our websites and services you agree to the collection, processing and transfer of your data as described in this privacy policy. This privacy policy applies to all online and web services (following “the services” or “the websites”) of NanoTemper Technologies and its legal entities (following “NanoTemper”), including, but not limited to, the NanoTemper website (www.nanotempertech.com, following “the website”), the NanoTemper webshop (shop.nanotempertech.com, following “the webshop”), the NanoTemper Explorer Community (https://nanotemper.my.site.com/explore, following “the community”), NanoTemper software crashreport (following “the crash report”) and NanoTemper Support Center (https://support.nanotempertech.com).

Websites of NanoTemper may contain links to external websites of other third parties, which are not maintained or affiliated with NanoTemper. NanoTemper is not able and will not control or enforce its own privacy policy or guarantee the accuracy, relevance, timeliness or completeness of any information on these external contents. We are using the CRM system of Salesforce.com Germany GmbH, Erika-Mann-Str. 31, 80636 München, to work on requests faster and more efficient (legitimite interest Art. 6 stc. 1 lit. f. GDPR).
Salesforce provides guarantee with standard contractual clauses to be compliant with european data privacy laws, if the data is processed within the US.
If data is transferred to Salesforce, Inc., this is done on the basis of the adequacy decision of the European Commission and the USA pursuant to Article 45(1) of the GDPR.

Meeting System of Microsoft Teams

For online meetings we are using “Teams” of Microsoft Ireland Operations, Ltd., One Microsoft Place,
South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland, to have virtual Meetings faster and more efficient (legitimite interest Art. 6 stc. 1 lit. f. GDPR).
Microsoft guarantees the processing of our data in data centres only in EU. Microsoft is processing the data of users only for technical processing of requests and is not passing them to third parties. Further information are available at:  https://privacy.microsoft.com/de-de/privacystatement.
If data is transferred to the USA, this is done pursuant to Article 45(1) of the GDPR on the basis of the adequacy decision of the European Commission. The involved U.S. companies and/or their U.S. subcontractors are certified under the EU-U.S. Data Privacy Framework (EU-U.S. DPF).

LinkedIn SmartLinks

To give access to limited and exclusive content, we make use of “LinkedIn SmartLinks” of LinkedIn Ireland Unlimited Company, 70 Sir John Rogerson’s Quay, Dublin 2,Dublin (legitimite interest Art. 6 stc. 1 lit. f. GDPR).

Users will need to consent to LinkedIn’s Privacy Policy and Cookie Policy separtely. By accepting those your information (Name or LinkedIn account data provided) will be shared with us to track the use of this content provided to you.

Job Applications

Within our job application process we are storing and processing especially cover letters, cv and employment references and personal data (e.g. address data, birth date or data about your career path). The personal data submitted by you is processed for the purpose of processing your application for our job postings within one of our companies. (Art. 6, 1 lit. b DSGVO, § 26 Abs. 1 BDSG).

The submitted data is processed by us. The encryption of your data sent by e-mail to jobs@nanotempertech.com, careers-us@nanotempertech.com, careers-emea@nanotempertech.com or any other of our e-mail addresses depends on your e-mail service provider.

In case the application is submitted through our career portal nanotemper.jobs.personio.de, ntt-careers-eu.jobs.personio.com, ntt-careers-us.jobs.personio.com or any other *.jobs.personio.com address is processed by the career portal provider Personio.

We point out, that job applications, especially cv’s, employment references and other submitted data may contain sensitive data (e.g. religion, handicaps). If you submit such data, you consent explicitly that NanoTemper Technologies may process this data within your job application process.

Recipients and categories of recipients of your personal data are within our actual application process

Because of our matrix organization, your data may be processed in a country outside of the EU (e.g. our subsidiary in USA), depending on the position you apply for (Art. 6 Abs. 1 lit. f DSGVO).

Your application documents and submitted data will be deleted six months after closing the job posting / end of the selection process.

If you apply through one of our career portals you can optionally sign up for our Talent Pool. In this case, we retain your application documents for matching your profile with future career opportunities. Your application documents and submitted data will be retained for a maximum of 12 months, or until you withdraw your consent by your taking your rights as a data subject.

Hosting

The hosting services used by NanoTemper are serving the purpose to deliver the follwing services: infrastructure- and platform-services, computing capacities, storage and database services, security services as well as technical maintainance services we need to operate our online services.
Here we or our service providers are processing inventory data, contact data, content data, contract data, usage data, meta- and communicaton data of customers, leads and interested parties and visitors of our online services based on our legitimate interest on an efficient and secure provision of our online services (Art. 6, par 1 lit. f GDPR in connection with Art. 28 GDPR (governing data processing addendums)

Rights of data subjects

Based on the applied legislation you as a data subject have different rights regarding your personal data. If you want to claim your rights, please contact the responsible via e-mail under privacy@nanotempertech.com. As a data subject you have the following rights:

1. Right of access

Data subjects have the right to obtain the following:

  • confirmation of whether, and where, the controller is processing their personal data;
  • information about the purposes of the processing;
  • information about the categories of data being processed;
  • information about the categories of recipients with whom the data may be shared;
  • information about the period for which the data will be stored (or the criteria used to determine that period);
  • information about the existence of the rights to erasure, to rectification, to restriction of processing and to object to processing;
  • information about the existence of the right to complain to the DPA;
  • where the data were not collected from the data subject, information as to the source of the data; and
  • information about the existence of, and an explanation of the logic involved in, any automated processing that has a significant effect on data subjects.

Additionally, data subjects may request a copy of the personal data being processed.

2. Right of rectification

Data subjects are entitled to require NanoTemper to rectify any errors in their personal data.

3. Right to erasure

Data subjects are entitled to require NanoTemper to delete their personal data if:

  • the data are no longer needed for their original purpose (and no new lawful purpose exists);
  • the lawful basis for the processing is the data subject’s consent, the data subject withdraws that consent, and no other lawful ground exists;
  • the data subject exercises the right to object, and NanoTemper has no overriding grounds for continuing the processing;
  • the data have been processed unlawfully; or
  • erasure is necessary for compliance with EU law or the national law of the relevant member state of the EEA/EU.

4. Right to restrict processing

Data subjects have the right to restrict the processing of personal data (meaning that the data may only be held by the controller, and may only be used for limited purposes) if:

  • the accuracy of the data is contested (and only for as long as it takes to verify that accuracy);
  • the processing is unlawful and the data subject requests restriction (as opposed to exercising the right to erasure);
  • NanoTemper no longer needs the data for their original purpose, but the data are still required by NanoTemper to establish, exercise or defend legal rights; or
  • If verification of overriding grounds is pending, in the context of an erasure request.

5. Right of data portability

Data subjects have a right to:

  • receive a copy of their personal data in a structured, commonly used, machine-readable format that supports re-use;
  • transfer their personal data from one controller to another;
  • store their personal data for further personal use on a private device; and
  • have their personal data transmitted directly between controllers without hindrance.

Inferred data and derived data (e.g., a credit score or the outcome of a health assessment) do not fall within the right to data portability, because such data are not “provided by the data subject”. In addition, the controller is not obliged to retain personal data for longer than is otherwise necessary, simply to service a potential data portability request.

6. Right to object to processing

Data subjects have the right to object, on grounds relating to their particular situation, to the processing of personal data, where the basis for that processing is either:

  • public interest; or
  • legitimate interests of the controller.

The controller must cease such processing unless the controller:

  • demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject; or
  • requires the data in order to establish, exercise or defend legal rights.

7. Right to object to processing for the purposes of direct marketing

Data subjects have the right to object to the processing of personal data for the purpose of direct marketing, including profiling.

8. Right to not be evaluated on the basis of automated processing

Data subjects have the right not to be subject to a decision based solely on automated processing which significantly affect them (including profiling). Such processing is permitted where:

  • it is necessary for entering into or performing a contract with the data subject provided that appropriate safeguards are in place;
  • it is authorised by law; or
  • the data subject has explicitly consented and appropriate safeguards are in place.

General use of our online service

Personal information, explicitly, voluntarily or implicitly provided will be collected, stored and processed by NanoTemper. As an example, this information is recorded when using our services. Information may also be collected when communicating through another media (support calls, mails) than direct use of the described NanoTemper services. 1. Log data Our systems automatically gather anonymous information about visitors, including IP addresses (shortened), operating system, browser type and version, screen resolution, browser language, and the times and dates of webpage visits as well as used content (pages) and technical status information or referrer URLs (address of the visited page linked to our service). The data collected does not include personally identifiable information and is used, as described above, for statistical analysis, to understand user behaviour, and to administer the site. NanoTemper may analyze the log data in case of a probable cause of unjustified or unlawful usage of our online services. Logfiles are deleted after 7 days. 2. Web Site Analytics When visiting and/or using our website and/or Community, NanoTemper will use different technologies and methods (open source tool Matomo) to collect statistical information of your visit and use of our service. This data is not sent to other servers or third parties; it is used in anonymized form to improve our services . IP addresses are stored in Matomo without the final tuple. Therefor we know the network of the user / visitor, not the specific computer. You can deactivate data collection for analytics with the individual cookie settings or by setting the “do-not-track” setting within your browser. The evaluation of the data is carried out on the basis of our legitimate interest pursuant to Article 6(1)(f) of the GDPR for statistical analysis of our website for optimization purposes. 3. Contact via e-mail contact forms, support requests When reaching out to us (e.g. with our contact form, support request or e-mail), we will collect and process your personal data for the purpose of your request. They will not be deleted afterwards as maybe later questions may occure. Further personal data is only collected and processed after your personal consent or based on a legal obligation, a pre-contractual situation or legitimite business interest. The legal basis in the case of consent is Article 6(1)(a) of the GDPR. Depending on the nature of the inquiry, the legal basis for this processing is Article 6(1)(b) of the GDPR for inquiries that you make as part of a pre-contractual measure, or Article 6(1)(f) of the GDPR if your inquiry is of another nature. We are storing your data for 30 days on our webservers as a backup if problems in following processes occur. Your contact data and request will be saved within our customer relation management tool until you ask for your right as a data subject. Depending on the requested products and your country we may forward your contact data to a partner distributor. The given data retention periods are only valid for contact requests handled directly by ourselves. By getting in touch with us through a contact form, request form, or register for a training, event or similar, we will store your data permanently within the scope of subject of agreement and in case of further questions. Further personal related data is only collected when explicitly agreed on or if no agreement is needed by legislation. Additionally we make use of mailing service ‘Pardot’ of ‘Salesforce’ to send our confirmation e-mails for our Resource Center Downloads, Request Quote, user trainings, workshops and seminars forms.. These e-mails contain tracking code which is analyzing if you received and read the confirmation e-mail. This data is used in our CRM system of Salesforce.com Germany GmbH, Erika-Mann-Str. 31, 80636 München, to work on requests faster and more efficient (legitimite interest Art. 6 stc. 1 lit. f. GDPR). GDPR. Your data is not automatically deleted upon your personal data subject request and stored at least for 4 years a contact regarding one of our products or services. Cookies are small text files that are saved on the device with which you access our website and/or Community. There are other technologies that are related, like Pixel-Tags (small “hidden” / “transparent” images within webpage and/or e-mail), Counter-Codes (code within the webpage and/or e-mail to identify visits). Additional Cookies may be used to improve and personalize marketing and sales activities. As an example this may include Cookies for “frequency capping” that assures that advertisings are not shown over and over again to the same user.

Personal Preferences for the usage of Cookies You may influence the usage of Cookies by your computer programs (e.g. browser) with your personal settings in these applications. It is often possible to automatically accept or reject Cookies as well as delete them at the termination of the application. We use OneTrust as a cookie consent management platform. This is necessary to apply your personal cookie preferences throughout the different technical platforms we are offering on our website. OneTrust will save your consent settings together with an unique personal identifier (id) as well as a date of the first consent and last update for your personal cookie settings. These entries will not be deleted automatically to assure that your personal settings are applied when revisiting our online services. A new unique identifier (id) is generated when you delete the cookies of your browser. Please be aware that the service provided by NanoTemper’s website and/or community may not work properly if you set your applications to reject or delete Cookies. 6. Social Media Buttons If you share our content through social media, for example by liking us on Facebook, following or tweeting about us on Twitter, or giving us a ‘+1’ via Google Plus, those social networks will record that you have done so and may set a cookie for this purpose. In some cases, where a page on our website includes content from a social network, such as a Twitter feed, or Facebook comments box, those services may set a cookie even where you do not click a button.  As is the case for all cookies, we cannot access those set by social networks, just as those social networks cannot access cookies we set ourselves. 7. Integration of External Services Based on our legitimate interest (here the analytic, optimization and frugal operation of our online services in terms of Art. 6, par 1 lit. f GDPR ) we are integrating external services of third party providers in our online services to use their services and contents (e.g. videos, fonts, following called “contents”). That entails that, the service provider of these contents process the IP address of the user, as contents can not be sent to the user without this address. We strive to use only those service providers that are using the IP address only for the delivery of contents. External service providers may also use so called “pixel-tags” (invisable graphics, also called “web beacons”) for statistical or marketing reasons. Through these pixel-tags the usage of the service may be tracked and analyzed. The pseudonymical data also be contained in Cookies and may be saved on your device and may contain other technical information about browser, operating system, referring pages, visiting duration as well as the usage of the services and may be connected to other information from other sources. Youtube We are integrating contents of the platform “YouTube”, provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland A connection is established between the provider's servers and your device. In the process, your IP address is also transmitted. For further information, please refer to the privacy policy for Vimeo Video: https://vimeo.com/privacy. jQuery We use jQuery CDN to properly provide the contents of our website. jQuery CDN is a service from jQuery, which functions as a Content Delivery Network (CDN) on our website. A CDN helps deliver the contents of our online offerings, particularly files such as graphics or scripts, more quickly using regionally or internationally distributed servers. When you access this content, you connect to the servers of jQuery, where your IP address and possibly browser data such as your user agent are transmitted. These data are processed exclusively for the purposes mentioned above and to maintain the security and functionality of jQuery CDN. The use of the Content Delivery Network is based on our legitimate interests, i.e., interest in a secure and efficient provision as well as the optimization of our online offerings pursuant to Article 6(1)(f) of the GDPR. In cases where there is no adequacy decision by the European Commission (including US companies that are not certified under the EU-U.S. DPF), we have agreed with the recipients of the data on other appropriate safeguards in accordance with Articles 44 et seq. of the GDPR. Online Presence in Social Media NanoTemper is using online presences within social media networks and platforms to communicate with customers, interested parties and users and to inform those about our services and goods. We point out that data may be processed outside of the European Union by using those services. Thus, there are risks for the users, e.g. it may be harder to exercise rights of data subjects. We point out that service providers comply to be compliant with EU data security standards (for third countries based on EU Standard Contractual Clauses). Additionally, we ensure that we only collaborate with providers who are certified under the adequacy decision of the European Commission pursuant to Article 45 of the GDPR. Additionally personal data of users are often used for purpose of opinion survey and commercial purposes. Thus user profiles may be created based on the user behaviour and following interests of users. Those profiles may be used to show specific commercials and ads to the user within or outside of the social media platform. For that purpose usually Cookies are saved on the users’ device which contain the users’ behaviour, interests and technical information. Those profiles may contain additional data regardless the users’ behaviour and usage (especially when you are a member of the social media platform and you are logged in). Processing of personal data is based on our legitimate interest on providing efficient information to the user and communicate with the user (Art. 6, par 1 lit. f GDPR). If users are asked for consent for data processing (e.g. by clicking on a checkbox or clicking on a consent button) , a legislative basis for a processing after Art. 6 par. 1 lit. a, Art. 7 GDPR is created. Additionally, additional measures are in place to have settings in place to comply with EU GDPR regulation. These are audited on a regular basis to keep the data protection level up. The subscription of our newsletter is based on an opt-in process. That means, you will receive our newsletter only after explicit consent. This consent is protocoled to prove the legal obligations. In our E-Mail-communication we are using web beacons (also called tracking pixel) to gain information on your interaction with our newsletter.

Contractual Obligations

NanoTemper is processing data of contract partner, customers, applicants and interested parties / leads (all together called “partners”) based on Art. 6 par. 1 lit. b GDPR to deliver contractual or pre-contractual services. Processed data, the kind and extend, purpose and necessity of their processing are determined based on the type of there underlying contractual relationship.

Processed data contain master data of contract partner (e.g. names, addresses), contact data (e.g. e-mail, telephone numbers) and contract data (e.g. contract matter, correspondence) and payment data (e.g. banking account details).

Special categories of personal data are absolutely not processed, except if they are part of an ordered or contractual processing.

NanoTemper processes personal data, which are necessary to explain and fulfill contractual services. We point out the necessity of their declaration as long as they are not evident for the contract partner. A disclosure to external persons or companies takes only place if it is necessary within the context of fulfilling the contract. When processing data as a processor on behalf of a controller, we are acting according to instructions of the controller and legal requirements.

NanoTemper processes data within the scope of administrative tasks and organisation of operation, financial accounting, regarding legal requirements, like archiving. Thus, the same data is processed as with fulfilling contractual services. Legal basis for processing is Art 6 par. 1 lit. c GDPR, Art. 6 par. 1 lit. f GDPR. Affected by this processing are customers, interested parties / leads, business partners and website users. The purpose and legitimite interest is in administration, financial accounting, office organisation, archiving of data, as well as tasks for performing and maintain our business, awareness of our tasks and delivering services. The deletion of data in context of our contractual services and contractual communication is based on our statement regarding data processing activities.

Within these processing activities NanoTemper discloses data to finance administration, consultants (e.g. tax accountants, chartered accountants, auditors or banks.

Any deletion of personal data is based on the legal requirements. Data is deleted, when it is not necessary to store them for reasons of contract fulfillment or legal obligation to preserve records or in context of any terms of warranties or similar duties.

Furthermore, personal data is processed on basis of business intererest, information regarding suppliers, organiser or other business partners (e.g. for later contacting). These, mostly company-related information, is stored permanently.

There is no guarantee the provision and access to our service. Service outages, discontinuities may occur. The servers used to provide our services are backed up on a regular basis.
